Dubai off-plan escrow, explained for developer finance teams

Every off-plan project in Dubai collects buyer payments into an escrow account. Here's how it works in practice, and where finance teams lose time.

What an off-plan escrow account is

Every off-plan project in Dubai must have one escrow account, held at a bank approved by the Dubai Land Department as a trustee. Buyer payments for units in the project must go into this account, not into the developer's own accounts.

The developer draws funds against certified construction progress: an engineer's certificate supports each release, and the trustee bank releases accordingly. Escrow keeps buyer money protected while the project is built.

How buyers pay instalments today

Most off-plan buyers pay over years, not at once: a deposit at booking, then instalments on the payment plan agreed in the SPA. Common plans are construction-linked milestones, a 1% monthly plan, and post-handover instalments after the keys are delivered.

Payment methods are mixed. Buyers hand over post-dated cheques at booking, transfer from UAE bank accounts, send international transfers from overseas banks, or pay the deposit by card. Each method creates its own paperwork for the finance team.

Where reconciliation breaks

The project has one pooled escrow account, and hundreds or thousands of buyers pay into it. Transfers arrive with missing or wrong references, or come from relatives, companies or overseas banks that are not the buyer named on the SPA.

Buyers send screenshots as proof of payment, and teams end up chasing the bank instead. Month-end reconciliation becomes manual matching of one bank statement line to one SPA, line by line, in spreadsheets.

Unit escrow accounts: one account number per unit sold

A unit escrow account is not a new legal account. It is an account number under the project's escrow account, tied to the unit's SPA and Oqood registration.

Each buyer pays into their unit's account number, so the money is identified the moment it lands. The bank balance always equals the sum of the unit balances, and per-unit figures are ready for releases, refunds and handover.

Replacing post-dated cheques with e-mandates

The UAE Direct Debit System lets a buyer sign one electronic mandate with UAE PASS that authorises the developer to collect each instalment on its due date.

Collection is scheduled, automatic and paperless. When a payment fails, the developer gets an alert the same day and can act, instead of discovering a bounced cheque weeks later.

Checklist for developer finance teams

  • Map every incoming receipt to a unit and buyer before treating it as collected.
  • Track proof of payment for each instalment, not just the bank statement.
  • Keep a running balance for every unit, not only the pooled escrow balance.
  • Reconcile monthly at unit level, not only at project level.
  • Have a follow-up routine for failed payments that starts within a day.
  • Prepare per-unit escrow balances before handover and final releases.
  • Confirm every mandate or cheque you hold against the SPA schedule.

Escrow questions, answered

Who holds the escrow account in Dubai?

A trustee bank approved by the Dubai Land Department holds the project escrow account. The developer requests releases against certified construction progress, and the bank controls the money.

Can buyers pay instalments by direct debit?

Yes. The UAE Direct Debit System supports electronic mandates signed with UAE PASS, so each instalment is collected automatically on its due date.

How do developers match transfers to units?

With a unit escrow account, each unit has its own account number, so a transfer is identified by the account it lands in. In a single pooled account, teams match references and amounts by hand.

What happens to escrow at handover?

Around handover, remaining funds are released per the project's rules and per-unit balances must be settled, which is far easier when every unit has had its own account number all along.

Is a unit escrow account a separate legal account?

No. It is an account number under the project's one escrow account, tied to the unit's SPA and Oqood registration. The legal escrow structure stays exactly as Dubai's law requires.
